California Penalties for Possession of Marijuana

According to the California Uniform Controlled Substances Act, marijuana is a schedule hallucinogenic substance, and possession for personal without a prescription from a doctor is illegal.

Marijuana for Personal Use

If you have up to and including 28.5 grams of the drug you will be fined $100. If you have more than 28.5 grams, you will be charged with a misdemeanor and fined up to $5000 and imprisoned up to 6 months.

Marijuana with Intent to Distribute

If you are caught with marijuana with intent to distribute any mount of the drug, you will be charged with a felony punishable by 16 to 36 months of imprisonment. However, if you are caught with the intent to sell or deliver any amount of the drug, you will also be charged with a felony punishable by two to four years of imprisonment. However, if a person has 28.5 grams or less of the drug and is planning to give a gift or simply transfer the drug, the crime will be considered a misdemeanor and punished by fine of up to $100.

If you’re growing any amount of cannabis you will be charged with a felony punishable by 16 to 36 months imprisonment. There is no charge for the possession of marijuana paraphernalia.
